This is the sixth in a series of posts regarding the Wisconsin Lemon Law. We hope to provide information and educate consumers who are having various vehicle problems.
Boat problems may be covered by the Magnuson-Moss Warranty Act, a Federal law that protects the buyer of any product that comes with an express written warranty. This law applies to any product that you buy that does not perform as it should.
The Magnuson-Moss Warranty Act ("MMWA") gives consumers considerable rights in dealing with the manufacturers of boats and other watercraft. This law guarantees that certain minimum requirements of warranties must be met, and provides for disclosure of warranties before purchase.
The MMWA significantly affects the rights of boat and watercraft buyers. For any product that has a written warranty, if any part of the product, or the product itself, is considered defective, the consumer may be entitled to relief including refund or replacement and payment of actual attorney fees and costs. Warranty repairs must be completed within a reasonable number of repair attempts and without charge. In determining the defective nature of a product, many law firms have successfully argued that the lemon manufacturers should be given three attempts to repair the defect before a finding can be made that the product is defective.
A consumer may pursue legal action in Wisconsin Circuit Court to enforce their rights under the Magnuson-Moss Warranty Act. The law provides for in addition, the consumer's attorney fees will be paid by the manufacturer if the consumer prevails.
The Magnuson-Moss Warranty Act was enacted by Congress in 1975 in response to widespread misuse by merchants of express warranties and disclaimers. The purpose of the Act is to make warranties on consumer products more easily understood and enforceable and to provide the law with better means to protect consumers.
